This User Agreement (hereinafter referred to as the "Agreement") is a legally binding agreement reached between you (hereinafter referred to as "user" or "you") and the operator of this APP (hereinafter referred to as "we" or "operator", operator name: ECO GREEN ENERGY LIMITED; address: RM 1903,19/F LEE GARDEN ONE 33 HYSAN AVENUE CAUSEWAY BAY HK; contact information: tech@eco-greenenergy.com) regarding the use of this APP. Before you start using this APP, please read the entire content of this Agreement carefully. Once you use this APP, it means that you have fully read, understood and agreed to be bound by all the terms and conditions of this Agreement. If you do not agree to any of the contents of this Agreement, please do not use this APP.
This APP provides real-time monitoring, data analysis, fault warning, remote control and other functions for energy equipment such as photovoltaic energy storage machines, smart sockets, smart meters, heat pumps, etc., aiming to help users manage and maintain photovoltaic power stations more efficiently. It specifically covers but is not limited to real-time viewing of equipment operating status, power generation, power generation income and other data of photovoltaic power stations, remote configuration of inverter parameters, receiving alarm notifications, etc.
However, the provision of services may be affected by a variety of factors, including but not limited to network conditions, equipment performance, software updates, the communication conditions of the photovoltaic power station equipment itself, and the service stability of third-party service providers. We do not guarantee that the services can always be provided uninterruptedly and without errors.
This APP requires you to register an account to use it. You should provide true, accurate, complete and valid information to register in accordance with the registration process we require. You are responsible for the authenticity and legality of the information you provide, and should update the information in a timely manner to maintain its accuracy. We are not responsible for any problems or losses caused by your provision of false information or failure to update information in a timely manner.
Users are responsible for the confidentiality of their personal information and bear any consequences resulting from information leakage.
We grant you a limited, non-exclusive, non-transferable license to download, install and use this APP on a mobile device or other compatible device that you lawfully own or control solely for personal, non-commercial purposes or legitimate business purposes related to a photovoltaic power plant that you own or manage.
When using this APP, you shall strictly abide by all applicable laws and regulations, and shall not publish or disseminate any illegal, harmful, infringing, obscene, violent, false, harassing, discriminatory or other negative information, nor engage in any illegal or criminal activities. For example, you shall not use this APP to interfere with the normal operation of the photovoltaic power station, or tamper with or forge monitoring data.
You should respect the legitimate rights and interests of other users, third parties and us, and shall not infringe on the privacy, reputation, intellectual property rights of others. Without the written permission of us or other relevant parties, you may not use, copy, disseminate any content in this APP, including but not limited to text, pictures, graphics, audio, video, etc., or use it for any unauthorized commercial purpose.
Users should bear the risks arising from the use of this APP.
Specific prohibited behaviors may also include but are not limited to sending spam, malicious screen swiping, interfering with the normal operation of the APP, attempting to undermine the security protection mechanism of the APP, using this APP to perform unauthorized operations on photovoltaic power station equipment, etc. If you violate the above prohibited behaviors, we have the right to take corresponding measures, including but not limited to warning, suspending or terminating your account usage rights, and pursuing your legal liability, etc. You shall bear full liability for any losses caused to us or other third parties.
You are responsible for keeping your account and corresponding login password and other authentication information safe. We are not responsible for any losses caused by theft or fraudulent use of your account due to your own reasons. If you find any security issues with your account, you should notify us immediately and we will assist you in taking appropriate measures, but we will not be liable for compensation for losses that have occurred before your notification.
You may not lend, rent, share or transfer your account to any third party for use, and you must comply with this Agreement and relevant laws and regulations when using your account to conduct operations. If we find that you have violated this provision, we have the right to suspend or terminate your account usage rights, and you will be solely responsible for all consequences resulting from this.
We have the right to modify, upgrade, suspend or terminate the service content and functions of the APP from time to time based on business development, legal and regulatory requirements, the upgrading of photovoltaic power station monitoring technology, and cooperation with third parties such as power station equipment suppliers. Where reasonably feasible, we will notify you of relevant changes in advance, but in emergency situations or special circumstances required by laws and regulations, we may not be able to notify you in advance. If any losses are caused to you due to changes or termination of services, we will bear the corresponding liability according to the specific circumstances and to the extent permitted by law.
The developer reserves the right to update, upgrade or modify this APP according to business needs. When necessary, the developer may terminate or interrupt the service of this APP at any time without prior notice to users.
We value your privacy protection and will collect, use, store and protect your personal information in accordance with our separately published privacy policy. The Privacy Policy constitutes a part of this Agreement. Your use of this APP indicates that you agree to the relevant provisions of our Privacy Policy. We promise to use your personal information only for the purpose and scope specified in the Privacy Policy and take reasonable security measures to protect the security of your information.
We may collect the following types of personal information, including but not limited to your registered account information, contact information, information about the photovoltaic power station you are in, and usage behavior information such as operation records and browsing history generated during your use of this APP. The purpose of collecting this information is mainly to achieve the monitoring and management functions of the photovoltaic power station, to provide you with better and more personalized services, and to ensure the safety of you and the photovoltaic power station.
The intellectual property rights of this APP (including but not limited to its software code, interface design, icons, text content, audio, video and other components) belong to us or relevant authorized parties and are protected by applicable copyright laws, trademark laws, patent laws and other laws and regulations. Without our written permission, you may not infringe our intellectual property rights in any way, including but not limited to copying, disseminating, displaying, mirroring, uploading, downloading, etc.
If you upload, publish, or contribute any content related to photovoltaic power plants (such as maintenance records of power plant equipment, data analysis reports, etc.) through this APP, you should ensure that you have legal intellectual property rights to these contents or have obtained corresponding authorization, and you grant us a global, royalty-free, sublicensable, non-exclusive license so that we can use, store, copy, modify, and disseminate your relevant content in order to achieve the operational purposes of this APP (such as display, promotion, data analysis, etc.), but we will not use your content for other commercial purposes unrelated to photovoltaic monitoring, and will respect your right to authorship and other related rights to the content.
Although we try our best to ensure the normal operation of the functions of this APP and the accuracy of the information provided, due to the complexity and real-time nature of photovoltaic power station monitoring data, as well as the various external factors that may affect it, we are not responsible for any direct or indirect losses caused by technical defects in the APP itself, untimely information updates, data display errors, etc., but we will try our best to repair and correct these problems in a timely manner.
This APP may contain links to third-party websites, services, etc., or display content provided by third parties. We are not responsible for the legality, security, accuracy, etc. of these third-party content and services. You access and use these third-party resources at your own risk. We recommend that you carefully read and comply with the terms of use and privacy policy of the relevant third parties when accessing and using third-party links and content.
If we are unable to perform our obligations under this Agreement due to force majeure (such as natural disasters, government actions, network failures, power supply interruptions, photovoltaic power station equipment failures, etc. that are beyond our reasonable control), we will not bear the corresponding liability for breach of contract, but we will try our best to take reasonable measures to reduce the impact of force majeure on you and resume service as soon as possible after the impact of force majeure is eliminated.
1.In any case, the developer shall not be liable for any direct, indirect, incidental, special and consequential damages arising from the use of this APP, including but not limited to loss of data, loss of profits, etc.
2. If any password for APP-controlled remote machine settings is obtained through third-party channels and such unauthorized configuration leads to machine damage or malfunction, our company shall not be held liable. All responsibilities shall fall upon both the user and the password provider.
3. Do not set the grid-connected power above 800W. Exceeding 800W may cause circuit overheating or fire. Any resulting consequences will be solely the user's responsibility, and our company shall not be held liable.
We have the right to modify this Agreement in a timely manner in accordance with the requirements of laws and regulations and business development, and will inform you through reasonable means such as posting notices in prominent locations within the APP and pushing messages. The modified agreement will take effect from the date of the notice. If you continue to use this APP after it takes effect, it means that you accept the modified terms of the agreement. If you do not agree to the modified agreement, you should immediately stop using this APP and handle related matters in accordance with our requirements, such as canceling your account.
In certain circumstances (such as if you seriously violate this Agreement, we stop operating the APP, the PV power station you are associated with no longer uses this APP for monitoring, etc.), we have the right to unilaterally terminate this Agreement, and you should immediately stop using this APP and handle related matters in accordance with our requirements, such as deleting the relevant data you stored on this APP, etc. After the termination of the agreement, we have the right to retain or delete your relevant information in accordance with the requirements of laws and regulations, but we will continue to fulfill our obligation to keep your information confidential.
This Agreement shall be governed by the laws of the People's Republic of China, excluding the application of any conflict of law rules.
If any dispute arises between you and us due to this Agreement or the use of this APP, we should first try to resolve it through friendly negotiation; if the negotiation fails, both parties agree to submit the dispute to a [specific dispute resolution institution, such as a court, arbitration institution] with jurisdiction for arbitration.
This Agreement constitutes the entire agreement between you and us regarding the use of this APP, and supersedes any previous oral or written agreements reached between the two parties regarding related matters.
If any provision of this Agreement is held to be invalid, illegal or unenforceable, it will not affect the validity, legality and enforceability of the other provisions, which shall continue to be valid and binding upon the parties.
Notifications between the two parties can be made through push messages within the APP, emails, etc. The notification is deemed to have been delivered to the other party from the time it is sent. However, if the notification cannot be delivered due to inaccurate contact information provided by the other party, the sender shall not be held responsible.
